California wage and hour laws are ever changing, whether it be by laws enacted in Sacramento or cases interpreting (or reinterpreting) the myriad of statutes and wage orders applicable to the diverse businesses operating in Kern County.

Almost unlike any other area of the law, changes seem to occur on a weekly or monthly basis, imposing new requirements or challenging long standing practices that may be rendered obsolete and, if not changed, expose employers to hundreds of thousands if not millions of dollars in claims.

In this session, Scott will go over the latest practices and procedures that wage and hour class action lawyers are targeting and offer tips on how to practically and effectively mitigate the risks of becoming a target. The focus will be on practices that your companies may be engaging in that present risk irrespective of how minor of an effect the practice or process may have on calculation of employee time or payment of wages.

For example, is there a scenario where rounding is acceptable and, if so, should employers engage in rounding even when the practice benefits employees.

What about employee self-rounding through the use of paper timesheets?

What meal period or rest break policies are causing employers trouble in wage and hour cases and how can those issues be addressed to minimize risk?

When does compensable time start and when does it stop?

These questions and many more will be discussed through practical examples and with real world potential fixes designed to reduce risk.
